You have stated we can prune the tree back to our property line, we had someone come to give us a quote. He unfortunately expressed due to the work needing it would make the tree unsafe and unbalanced. Therefore he had quoted us on two jobs, please see invoice attached. We love the tree however his stated it’s only half the size and will continue to grow, we can not afford to keep cutting this back every 6-12months, he has given us the option of removing and planting a tree better for the area and environment. Please see attached. I have crossed out my private details. We would love the second option best, we would ensure the work is completed to the best standard and keep ontop of any future work needed with the trees. I have confirmed this is not a protected tree, and has no TPO. It’s classed as a street tree. But we can not prune it back to the property line due to half of the tree hanging over garden. The gentleman is fully insure ect - see attached. But he needs it in writing that we have permission.

  • This tree is also coursing damage to our fence which we had to bring forward and lose some garden. However this is now putting a strain on our new fence which is now leaning forward. We can not do anything about replacing the fence without sorting the issue of the tree

  • Has had someone to issue a quote for cutting tree back, but deemed it would make tree unstable due to being too uneven and unbalance on one side, if this could be raised to be looked at by the team

  • Resident has called back as they have had no response to the updates or the information that they have provide, they are more then happy to meet with a tree officer to be able to come to a solution for the tree. They are concerned at the size of the tree and how much more it could grow. Would a officer be able to contact the resident as soon as possible thank you.

  • Resident has phoned as still not received a response following this report, as stated above they are unable to have branches cut back themselves as tree is largely overgrown on both sides and cutting back just there side would cause the tree to be unbalanced, if this could be inspected JW

  • Please accept our apologies for the delayed response. We have reviewed the quote specification provided. Under the governance of our Tree Management Strategy the reasons given would not meet the threshold for pruning or removal. You do not need the Councils permission to exercise your common law right to prune back to the boundary anything which overhangs your airspace at your own effort or expense. The key limitation of your common law right is that you must not do anything which leads to the destruction of the tree. If you undertake a reduction within the specification given in your quote limited to elements overhanging your property boundary it will not leave the tree unbalanced. We advise that you proceed on this basis.
