Garden being extended towards bridleway

The house next door to this one has already built a new fence to add land to the property that was previously a verge to the bridleway. This has been reported here. Now this house has erected what looks like a temporary fence, which also takes land from the bridleway and includes it in the garden. Can gardens simply be extended in this way? Who owns the land where the bridleway is? Can the house owners be required to put the new fences where the old fences were, leaving more land along the bridleway?
